Gizlilik Politikası

Kısa özet: Hesap ve giriş yok. Günlüğün (öğünler, su, adın, kalori hesaplayıcıya girdiğin bilgiler) yalnızca cihazında durur ve bize gönderilmez. Fotoğraf analizi isteğe bağlıdır; bir fotoğraf yalnızca o fotoğraf için onay kutusunu işaretlediğinde, analiz için OpenAI'ye (yedek olarak Google Gemini'ye) gönderilir. Uygulama reklam gösterir (Google AdMob) ve reklam ölçümü için TikTok SDK'sı, Android'de kullanım istatistiği için Firebase Analytics kullanır; bu hizmetler cihazınla ilgili bazı teknik veriler alır.

1. Kapsam ve veri sorumlusu

Bu politika, App Store veya Google Play'da yayımlanan Kalori Defteri AI uygulamasını ("Uygulama") kapsar. Uygulamayı Çağın Emek Davarcı (cagan_inc adıyla yayın yapan bağımsız geliştirici, Türkiye) yayımlar ve 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") bakımından veri sorumlusudur. İletişim: cagan@caganinc.com

2. Cihazında kalan bilgiler

Aşağıdakiler yalnızca cihazının uygulama depolamasında tutulur; bize veya başka birine gönderilmez:

Öğün ve beslenme kayıtları sağlığınla ilgili bilgi içerebilir. Bu kayıtlar cihazından çıkmadığı sürece bizim tarafımızdan işlenmez. Günlüğünü Ayarlar › Günlüğümü dışa aktar ile dosya olarak alabilirsin; dosyayı nereye göndereceğini sen seçersin. Ayarlar › Hesabımı ve verilerimi sil ile ya da uygulamayı silerek tüm verileri silebilirsin. Cihaz yedeklemesini (iCloud, Google) açtıysan bu veriler senin yedeğinde de bulunabilir.

4. İzinler

iOS'ta kamera ve fotoğraf arşivi izni yalnızca fotoğraf eklemek istediğinde sorulur. Android sürümü kamera izni istemez; fotoğrafı sistemin kamera veya galeri ekranından seçersin. Android'de reklam kimliği (AD_ID) izni reklam SDK'sı için kullanılır.

5. Reklamlar: Google AdMob

Uygulama, Plus aboneliği olmayan kullanıcılara Google AdMob ile reklam gösterir; ödüllü reklam izleyerek ek fotoğraf analizi hakkı kazanılabilir. Uygulama reklam isteklerini kişiselleştirilmemiş reklam olarak gönderir. Buna rağmen Google Mobile Ads SDK; reklam kimliği (Android, sıfırlanabilir), cihaz modeli, işletim sistemi, dil, IP adresi ve buradan çıkarılan yaklaşık bölge ile reklam etkileşimlerini; reklam gösterimi, sıklık sınırı, ölçüm ve dolandırıcılığın önlenmesi amacıyla toplayabilir. Avrupa Ekonomik Alanı, Birleşik Krallık ve İsviçre'de reklamlar yüklenmeden önce Google'ın onay formu gösterilir. Tercihlerini Ayarlar › Reklam gizlilik tercihleri ile değiştirebilirsin. Günlüğün ve fotoğrafların reklam hizmetlerine gönderilmez. Ayrıntılar: Google, uygulamalardan gelen bilgileri nasıl kullanır.

6. Reklam ölçümü: TikTok ve Meta

Uygulamanın reklamlarını TikTok'ta ve Meta'nın platformlarında (Facebook, Instagram) yayımlayabiliriz. Bu reklamların işe yarayıp yaramadığını ölçmek için uygulamada TikTok Business SDK ve Meta SDK (Facebook SDK, uygulama olayları) kullanılabilir. Bu SDK'lar etkin olduğunda uygulamanın yüklenmesi, açılması ve satın alma gibi olayları, cihaz bilgilerini (model, işletim sistemi, dil), IP adresini, Google Play yükleme kaynağını ve Android'de reklam kimliğini ilgili şirkete gönderir. iOS'ta bu SDK'lar ATT izni istemez ve IDFA'ya erişmez; ölçüm Apple'ın SKAdNetwork altyapısıyla yapılır. Hangi sürümde hangi ölçüm aracının etkin olduğu, mağaza sayfasındaki veri güvenliği ve gizlilik bölümünde belirtilir. Günlüğün, öğün fotoğrafların ve sağlık bilgilerin bu şirketlere gönderilmez. 6.1 Analitik: Google Analytics for Firebase (yalnızca Android)

Android sürümünde uygulamanın toplu olarak nasıl kullanıldığını anlamak için Firebase Analytics kullanılır. Firebase; uygulama örneği kimliği, reklam kimliği, cihaz modeli, işletim sistemi, dil, ülke ve yaklaşık bölge ile ilk açılış, oturum ve uygulama içi satın alma gibi olayları otomatik olarak toplar. Ayrıca Plus ekranının görüntülenmesi ve satın alma adımları (başlatma, vazgeçme, tamamlama) kişisel veri içermeyen olaylar olarak ölçülür. Günlüğün, öğün fotoğrafların ve adın Firebase'e gönderilmez. Olay verileri 2 ay, kullanıcı düzeyindeki veriler en fazla 14 ay saklanır. Ayrıntılar: Firebase gizlilik bilgileri.

7. Abonelik ve satın alma

Kalori Defteri Plus aboneliği Apple (iOS) veya Google Play (Android) üzerinden satılır ve doğrulanır. Kart ve fatura bilgilerin uygulamaya ve bize ulaşmaz; uygulamaya yalnızca aboneliğin etkin olup olmadığı bilgisi gelir. Araya başka bir ödeme veya abonelik hizmeti girmez.

8. Değerlendirme isteği

Uygulama, Apple'ın veya Google Play'in uygulama içi değerlendirme penceresini gösterebilir. Puan ve yorumun doğrudan mağazaya gider; kimin puan verdiğini göremeyiz.

9. Bize e-posta gönderdiğinde

cagan@caganinc.com adresine yazdığında e-posta adresini, yazdıysan adını ve mesajını yalnızca sana cevap vermek, hata bildirimini incelemek veya KVKK başvurunu sonuçlandırmak için işleriz. Yazışmalar e-posta hizmet sağlayıcımız Google'ın (Gmail) sunucularında saklanır ve talebin sonuçlanmasından sonra en geç iki yıl içinde silinir.

10. Yurt dışına aktarım

Fotoğraf analizi (Cloudflare, Google), reklam (Google) ve reklam ölçümü (TikTok, Meta) hizmetlerinin sunucuları Türkiye dışında, başta ABD olmak üzere farklı ülkelerde bulunabilir. Fotoğraf analizi için aktarım, her fotoğrafta verdiğin açık onaya dayanır. Diğer aktarımlar KVKK'nın 9. maddesindeki usul ve güvencelere uygun olarak yapılır; ayrıntılar KVKK sekmesindedir.

11. Yaş sınırı

Uygulama 18 yaş ve üzeri kullanıcılar içindir; başlangıçta 18 yaşında veya daha büyük olduğunu onaylaman istenir. Bilerek 18 yaş altındaki kişilerden veri işlemeyiz.

6698 sayılı Kişisel Verilerin Korunması Kanunu'nun 10. maddesi ve Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ uyarınca hazırlanmıştır.

2. İşlenen veriler, amaçlar ve hukuki sebepler

Günlük kayıtların (öğünler, su, ad) yalnızca cihazında tutulur ve tarafımızdan işlenmez.

3. Toplama yöntemi

Veriler, uygulama ve uygulamadaki yazılım geliştirme kitleri (SDK) aracılığıyla elektronik ortamda, kısmen otomatik yollarla ve e-posta yoluyla toplanır.

5. Saklama süreleri

Fotoğraf ve analiz sonucu tarafımızdan saklanmaz. E-posta yazışmaları talebin sonuçlanmasından sonra en geç iki yıl içinde silinir. Reklam ve ölçüm hizmetlerinin topladığı veriler, ilgili şirketlerin saklama politikalarına tabidir.

6. Hakların (KVKK m. 11)

Kişisel verilerinin işlenip işlenmediğini öğrenme; işlenmişse bilgi talep etme; işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme; yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme; eksik veya yanlış işlenmişse düzeltilmesini isteme; KVKK m. 7 çerçevesinde silinmesini veya yok edilmesini isteme; bu işlemlerin aktarıldığı üçüncü kişilere bildirilmesini isteme; münhasıran otomatik sistemlerle analiz sonucu aleyhine bir sonuç çıkmasına itiraz etme ve kanuna aykırı işleme nedeniyle zararın giderilmesini talep etme haklarına sahipsin. Açık rızanı her zaman geri alabilirsin; bunun için fotoğraf analizini kullanmaman yeterlidir.

7. Başvuru

Başvurunu, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ'e uygun olarak adını, soyadını, yazışma veya e-posta adresini ve talebini belirterek cagan@caganinc.com adresine iletebilirsin. Başvurun en geç 30 gün içinde ücretsiz sonuçlandırılır; işlem ayrıca maliyet gerektirirse Kişisel Verileri Koruma Kurulu'nun tarifesindeki ücret alınabilir. Cevabı yetersiz bulursan KVKK m. 14 uyarınca Kurul'a şikâyette bulunabilirsin. Google, TikTok ve Apple'ın kendi işlemeleri için doğrudan bu şirketlere de başvurabilirsin.

Kullanım Koşulları

Bu Koşullar, Kalori Defteri AI uygulamasının ("Uygulama") kullanımını düzenler. Uygulama Çağın Emek Davarcı (cagan_inc adıyla yayın yapan bağımsız geliştirici, Türkiye) ("biz") tarafından sunulur. Uygulamayı kullanarak bu Koşulları kabul etmiş olursun.

1. Mağaza koşulları

iOS'ta lisans, Apple Standart Son Kullanıcı Lisans Sözleşmesi kapsamında verilir; bu Koşullar onu tamamlar ve lisans konusunda çelişki olursa Apple EULA uygulanır. Bu Koşullar Apple ile değil, seninle bizim aramızdadır; Uygulamanın içeriği, bakımı, desteği ve uygulamayla ilgili talepler bakımından Apple değil biz sorumluyuz. Apple ve iştirakleri bu Koşulların lehdar üçüncü kişileridir. Android'de Google Play Hizmet Şartları da geçerlidir.

2. Yaş

Uygulama 18 yaş ve üzeri içindir.

3. Sağlık uyarısı

Uygulama bir beslenme günlüğüdür; tıbbi cihaz değildir ve tıbbi, diyet veya beslenme tavsiyesi vermez. Kalori ve besin değerleri, özellikle fotoğraf analiziyle elde edilenler, tahminidir; porsiyon, gizli yağ ve pişirme yöntemi nedeniyle gerçek değerden farklı olabilir. Kaydetmeden önce kontrol et. Hamilelik, emzirme, diyabet, yeme bozukluğu veya başka bir sağlık durumun varsa, beslenme kararlarını bir hekim veya diyetisyene danışarak ver.

5. Fotoğraflar ve içerik

Yalnızca paylaşmaya yetkili olduğun fotoğrafları analiz için gönder. Başka kişilerin yüzlerini, kimlik bilgilerini veya özel belgeleri içeren fotoğraf gönderme. Analiz hizmetini, kötüye kullanmak, otomatik istek göndermek veya sınırları aşmak için kullanamazsın.

6. Lisans ve fikri mülkiyet

Uygulamayı kişisel, ticari olmayan amaçlarla kullanman için sınırlı, devredilemez bir hak verilir. Uygulamanın adı, tasarımı, kodu ve içerikleri 5846 sayılı Fikir ve Sanat Eserleri Kanunu kapsamında korunur. Açık kaynak bileşenler kendi lisanslarına tabidir (Lisanslar sekmesi).

7. Hizmetin sürekliliği

Fotoğraf analizi üçüncü taraf hizmetlere (Cloudflare, Google) bağlıdır; zaman zaman yavaşlayabilir veya kullanılamayabilir. Özellikleri geliştirme, değiştirme veya kaldırma hakkımız saklıdır; ücretli bir özelliği kaldırırsak mevzuattan doğan hakların korunur.

8. Sorumluluk

Uygulama "olduğu gibi" sunulur. Mevzuatın izin verdiği ölçüde dolaylı zararlardan sorumlu değiliz. Bu sınırlama, kast veya ağır ihmalden doğan sorumluluğumuzu (6098 sayılı TBK m. 115) ve 6502 sayılı Tüketicinin Korunması Hakkında Kanun başta olmak üzere sözleşmeyle kaldırılamayan haklarını etkilemez.

9. Değişiklikler

Koşulları güncelleyebiliriz; güncel metin uygulamada ve caganinc.com/kalori-defteri.html adresinde yayımlanır.

10. Uygulanacak hukuk ve uyuşmazlık

Türkiye Cumhuriyeti hukuku uygulanır. Önce cagan@caganinc.com adresinden bize ulaşmanı rica ederiz. Tüketici olarak, Ticaret Bakanlığı'nın her yıl ilan ettiği parasal sınırlar içinde yerleşim yerindeki veya işlemin yapıldığı yerdeki Tüketici Hakem Heyeti'ne, bu sınırların üzerinde Tüketici Mahkemesi'ne başvurabilirsin. Türkiye dışında yaşıyorsan, kendi ülkendeki zorunlu tüketici hakların saklıdır.
